You’re About to Pay Higher Online Taxes After Supreme Court Ruling

Online shopping just got a bit more expensive with new sales tax rule

Many big retailers, such as Amazon.com and Macy's, already collected sales tax for online purchases because they had warehouses or stores in those states.

The decision reverses two Supreme Court rulings from decades ago, which said states couldn't require retailers to collect and remit sales taxes if those retailers weren't physically located in the taxing state. They had resulted in some companies not collecting sales tax on every online purchase. "The change effected by the Court's decision will promote parity between our state's brick and mortar businesses and competing out-of-state sellers".

For small businesses, local advertising may now more effectively draw consumers away from the e-Commerce giants. "Extra sales tax makes the hole smaller next year". In upholding the ruling the Supreme Court overturned a 1992 ruling that required a "physical presence" in a state in order to mandate collection of sales tax.

The Supreme Court today announced its decision in the case of South Dakota v. Wayfair, Inc. This will be a huge boost to state budgets, but online retailers won't be pleased. Now, rivals will be charging sales tax where they hadn't before.

Justices Ruth Bader Ginsburg, Clarence Thomas, Neil Gorsuch and Samuel Alito concurred.

Chief Justice John Roberts offered the dissenting opinion, along with Justices Stephen Breyer, Elena Kagan, and Sonia Sotomayor.

The Illinois change isn't a new tax, but rather a decision to force online conglomerates to enforce the existing statutes.

You'll see varying estimates going around of how much more sales tax revenue states might collect if they enact laws like South Dakota's.

Will people be turned off online shopping by a sales tax?

South Carolinians soon could pay more to shop online after the U.S.

"It's a small part of the total sales and use tax revenue, but it's significant", he said. Legislative action has been stalled while the Supreme Court was deciding this case. "Regardless of the sales tax benefit, it will benefit our small businesses in Columbia".

Sen. Ann Cummings, D-Washington, chair of the Senate Finance Committee, mentioned during discussion of the bill Thursday that the online sales tax could help alleviate some of the education spending stress that has become a recurring problem in Montpelier. "When our local businesses suffer, so do we", he added.

NRF and other retail groups said in a second brief filed this year that lack of uniform collection is "inflicting extreme harm and unfairness" on local retailers by "distorting the retail market in favor of absentee ecommerce".

But what's also needed is some legislation that would level the playing field for all businesses that sell products online.

Online shoppers may be subject to sales tax when making purchases under a Supreme Court Decision made this Thursday.

"I want to stress that we're not looking at this as an additional revenue stream".
