A Turkish court rejected an Australian request to extradite a citizen it believes is a top recruiter for the Islamic State in Iraq and Syria (ISIS) group, Australia's foreign minister said on Friday (July 20), in a setback for Canberra's efforts to prosecute him at home.

Melbourne-born Neil Prakash has been linked to several Australia-based attack plans and has appeared in ISIS videos and magazines. At the end of the hearing he said: "Democracy is not legitimate".

Prakash launched into an attack on the judge in a mix of English, Arabic and Turkish during proceedings.

Australia's Daily Telegraph newspaper reported from Kilis that Prakash was initially ordered to be freed but was later charged under Turkish law with being an ISIS member. In fact, back when George Brandis was the attorney-general, he called Neil Prakash the principal Australian reaching back from the Middle East into Australia.

Prakash's lawyer Mehmet Alper Unver said there was no obstacle to his client being released from jail, barring further charges or indictments against him, according to the ABC.

A Melbourne court sentenced Besim in September 2016 to 10 years in prison for his attempt to commit an act of terrorism on Australian soil.
