A judge deciding the fate of a pizza delivery guy who was detained by ICE last month suggested Tuesday that the food courier should be spared from deportation while he fights for legal residency in the US.

"Well, the powerful are doing what they want, and the poor are suffering what they must", Crotty said after hearing assistant U.S. attorney Joseph Cordaro defend the government's actions.

Villavicencio's lawyers say he should be released from custody as he pursues his February application to gain legal immigration status from his marriage to a United States citizen. It is our position that the Federal government wholly failed to address or justify their cruel treatment of Mr. Villavicencio, a person with no criminal record, a US citizen wife, and two young USA citizen daughters.

Villavicencio was detained by immigration authorities last month. "Mr. Villavicencio was held for 53 days, and that is 53 days too long-this never should have happened".

Assistant U.S. Attorney Joseph Cordaro argued for the case to be transferred to New Jersey.

The 35-year-old is married with two children who were born in the United States. "Why do we want to enforce the order? It makes no difference in terms of the larger issues facing the country".

But they would tell the gossip column that they responded to a "medical emergency" at her home at 11:40 a.m. local time. Lovato said her dad was an alcoholic and addict ad her mother tried to keep her away from that life.

The case has attracted widespread attention amid a crackdown by the administration of Donald Trump on illegal immigration.

Villavicencio was being held at a detention center in New Jersey since his arrest. Trump, a Republican, has said his policies are created to keep the country safe. They have two young girls.

New York Gov. Andrew Cuomo had called for Villavicencio's release.

Villavicencio was arrested on June 1 after he failed to provide valid identification at Fort Hamilton in Brooklyn. A background check showed he had been ordered to leave the United States in 2010 but stayed.

No real progress has been made since Villavicencio was first detained, beyond a judge in June granting a temporary restraining order pending a hearing on Villavicencio's case.

In a letter to the ICE office in NY, the Democrat said Villavicencio's "expedited removal serves no legitimate public safety objective and the circumstances leading to his arrest and detention raise serious legal and policy concerns".

The Legal Aid Society, which has been representing Villavicencio, said in a statement that "the rule of law, humanity and morality prevailed tonight with the court's order releasing Pablo back to his family and community".
