Police said France smelled of alcohol and slurred his words during the traffic stop.

Police said France was released at 9:30 a.m. Monday after arraignment.

In response to a request for comment, NASCAR Managing Director of Communications Jon Schwartz issued the following statement via email on Monday: "We are aware of an incident that occurred last night and are in the process of gathering information". "Effective immediately, I will be taking an indefinite leave of absence from my position to focus on my personal affairs".

France became NASCAR's CEO and chairman in 2003, after his father Bill France Jr.

NASCAR vice chairman and executive vice president Jim France - Brian's uncle - will serve as interim chairman and CEO. His brother Jim France, who now serves as NASCAR's Vice Chairman and Executive Vice President, has assumed the role of interim chairman.

France was arrested and hauled to a nearby station where he was book for DUI and criminal possession of a controlled substance in the 7th degree.

A 14-year-old boy was on the 200 block of South Pulaski around 2:50 a.m. when he heard shots and was wounded in the leg. Four people were wounded, including a 13-year old boy, a 16-year-old boy, a 17-year-old girl and a 25-year-old woman.

Additionally, police say, France was also allegedly found to be in possession of oxycodone pills.

This latest reported incident comes just after NASCAR was celebrating the first win of Elliott's career.

"The France family is locked and loaded in its dedication to NASCAR", France told SiriusXM NASCAR Radio. There's nothing to report on that.

The police report goes on to reveal that once France was arrested, the officer searched France's vehicle, and found oxycodone, a controlled substance, in the auto.

France later told an officer called to his home that he was drinking a soda and "bumped into something".
