New organ donation law could save 700 more lives every year

Legislation to introduce the new framework for organ and tissue donation will be debated in parliament later this year, with the system expected to come into effect in spring 2020, the health department said on Sunday.

While the new system shifts the balance of presumption in favour of organ donation, those who do not wish to donate their organs will still be able to record their decision on the NHS Organ Donor Register, either via NHS Blood and Transplant's website or by calling their helpline.

The new law on organ donation will be called "Max's law" after Max Johnson, 10, of Winsford, Cheshire, who was saved by a heart transplant in August previous year.

"The problem with opt-outs is that - while it does save lives - people may not be aware that that is the default assumption.so people will be "donating" their organs without knowing they are doing that".

The new scheme will also include an opt out for those who do not wish to take part.

Jackie Doyle-Price, parliamentary under-secretary of state for mental health and Inequalities said: 'Organ donation saves lives.

'But organ donation remains a gift. I want to encourage people who wish to give life in the event of their death to take the time to record their wishes and discuss it with their family.

There will be exceptions - children under 18, those with diminished mental capabilities, and foreigners who have been in the country less than 12 months - and relatives can still override the "presumed consent", if the "donor" has relatives in the first place to object.

"We hope that more people will join the great cause to let love continue", said Yang Jiayin, head of the organ transplant center at Sichuan University's West China Hospital.
