Customers who ordered their vehicle before July can still benefit from the programme until mid-September-except for hundreds of Tesla customers, according to the firm. They weren't the only ones, though, and Tesla is suing the government alleging it has suffered "substantial harm" as a result of the sudden transition leaving out buyers of its vehicles.

In July the provincial government announced that the benefits apply to those auto owners who purchased auto through the dealership, subject to the delivery and vehicle registration until September 10.

The lawsuit asks the province's superior court to quash what is described as an "arbitrary and entirely unreasonable" decision.

It's not clear what the company is seeking in damages, but Tesla Canada claims that each day "the unquantifiable and irreparable harm grows".

None of the company's claims have been proven in court.

The Ministry of transportation Ontario has not commented on the situation.

That's because while Tesla dealerships are owned by Tesla, meaning that you order your vehicle directly from Telsa, virtually all other new auto dealerships are franchises.

Toronto teacher Kurtis Evans, 38, said he was planning to sell his current vehicle - and was counting on receiving the maximum $14,000 rebate - to be able to afford the $71,000 price of the auto he ordered in June.

He added Tesla has agreed to provide a refund of the deposit. Vehicles ordered before July 11 and delivered and registered before September 10 would still qualify for the incentive.

"Doug Ford's Ontario is closed for business, and families are going to pay the price", she charged.

Overall vehicle sales in Canada grew 4.8 per cent to a record 2.08 million past year.
