Aadhaar Verdict: Section 57 struck down; mobile companies, banks can not demand Aadhaar

It is necessary for private companies to delete the Aadhaar data they have collected so far, because they have been barred from using Aadhaar information now that the Section 57 of the Aadhaar Act has been struck down. During the hearing, the judges held that the demands made by officials for Aadhaar card are in violation of the 2013 interim order.

There are three sets of judgements being pronounced on the issue.

Ravi Shankar Prasad, Union Minister for Electronics and IT, law and justice, said that the court had struck down only a portion of Section 57 that referred to contracts and urged the fintech industry not to "panic" over the ruling. While it was initially well-received, Time reports that many residents now feel that Aadhaar is a not particularly secure, easy to hack, widespread surveillance program (and Edward Snowden agrees, by the way).

He emphasised that there is fundamental difference between the Aadhaar and other identity proofs. "As far as I am concerned, the state can not take away my body", he said.

April 17: SC raises concerns that there is a threat of Aadhaar data misuse. About 30 petitioners went to court to argue that the scheme infringed on privacy.

"If Aadhaar works really well, people just receive the same benefits as before", says Reetika Kheera, an Indian economist and social scientist.

The Supreme Court has declared the Centre's flagship Aadhaar scheme constitutionally valid.

Man arrested after CHASING plane at Dublin Airport
The man reportedly became agitated when he was told by staff at the boarding gate that he would not be able to board the flight. A ground crew member who witnessed the freakish incident said Kehoe "just ran from the building towards the plane".

It also cautioned the government and state-run organisations against denying citizens state benefits, like subsidised food grain, for lack of an Aadhaar identity.

The way people have been harassed and spammed for Aadhaar numbers in the last one year can be undone, only if these companies now show compassion for their users.

Mr Mukherjee said the government now urgently needs to pass a legislation on data sharing and privacy that will take into account the specific requirements of India.

It should be noted that the Unique Identification Authority of India (UIDAI) is already in possession of biometric data of over a billion Indians.

In that sense, the Aadhaar verdict provides an opportunity to review what has been achieved and how we can move forward, building on areas of strength while addressing the challenges of the future, the experts said. Again and again they informed us - and disingenuously so - that Aadhaar details were mandatory to avail their services.

The decision on Wednesday settles several major questions that have hung over the Aadhaar in the decade since it was first proposed by the previous Congress government and then vastly expanded by current prime minister Narendra Modi.

The government says the project will lead to a "social revolution".
