NBC reports that Katie McClure and boyfriend, Mark D'Amico, must turn over the money left over from the donations raised previous year for Johnny Bobbitt, 35, a homeless man who assisted the couple after he gave them his last $20 when they ran out of gas on the I-95 freeway in Kensington, Pennsylvania.

Fallon estimated that GoFundMe would have taken about $30,000 to $40,000 in commission from the more than $400,000 that was raised, which means more than $250,000 should be left.

Kate McClure, 28, and Mark D'Amico, 35, were ordered to put what's left of the money in an escrow account, in response to a lawsuit filed by homeless veteran Johnny Bobbitt Jr., the newspaper reported. The fundraiser was inspired by Bobbitt's act of kindness toward the woman, Kate McClure, the Philadelphia Inquirer reported.

The couple deny Mr Bobbitt's claim they helped themselves to the money.

Bobbitt's lawyer, Chris Fallon, did admit to reporters that his client had a substance abuse issue.

"The idea my clients are the bad guys.is completely not true", Ernest E. Badway said, according to the Philadelphia Inquirer.

When he bought her the petrol, she didn't have money to repay him at the time, but sought him out days later to give him the money, and visited him a few more times to bring food and water.

"I didn't want to be pressuring to get a lawyer or do anything because I didn't want to seem ungrateful", Bobbitt told Philadelphia TV station ABC6 after the ruling.

But D'Amico also insisted to the Inquirer that he won't give Bobbitt the money until he is sure the veteran is free of drugs, stating that he would rather "burn [the money] in front of him". Some of the money GoFundMe donors gave to him ended up in the pockets of drug dealers, Bobbitt told the Inquirer.

Promislo said earlier this month Bobbitt was back to living on the streets of Philadelphia "in harm's way".

The money will be transferred to an account controlled by Mr Bobbitt's lawyers but can't be used until the judge determines how it will be managed.

McClure, a receptionist for the New Jersey Department of Transportation, and D'Amico, a carpenter, have denied those claims.

D'Amico told the Philadelphia Inquirer last week that roughly $AU270,000 was left of the $AU546,000 raised. Fallon claims that the couple spent about $75,000 on Bobbitt, which would include the trailer and 1999 Ford Ranger truck they bought for him. And within 13 days, D'Amico said on "Megyn Kelly Today", Bobbitt had blown through it.
