In an op-ed Whitaker wrote past year, he argued that "any investigation into President Trump's finances or the finances of his family would require Mueller to return to Rod Rosenstein for additional authority under Mueller's appointment as special counsel". Beyond Mueller, but also within the Justice Department's oversight, is a federal investigation into Trump's longtime legal fixer, Michael Cohen, who admitted as part of a guilty plea in August to coordinating with Trump on a hush-money scheme to silence a porn actress and an ex-Playboy model who say they had affairs with Trump.

Since stepping into his new role on Wednesday, Whitaker has faced questions - principally from Democrats - about whether he should recuse from the Russian Federation investigation, given that he has written opinion pieces in the past about the investigation, and is a friend and political ally of a witness.

Trump "crossed a red line" in appointing Whitaker to oversee the Mueller probe, the group wrote on its website. "There's no collusion", Trump said on Wednesday.

In an op-ed published a year ago by CNN, Whitaker warned Mueller would be crossing a "red line" if his investigation looked into the finances of the Trump family.

"I think Congress should regulate things that harm people, and that is the hard drugs and the like that dramatically hurt citizens, cause violent crime in our communities, and those should be regulated", he said.

More alarmingly for Democrats, Mr Whitaker himself had outlined a specific way to stymie the Russian Federation probe. Senate Minority Leader Chuck Schumer said Wednesday that "protecting Mueller and his investigation is paramount".

Trump had repeatedly criticized Sessions for recusing himself from any investigation into potential Russian meddling in the 2016 USA presidential election. According to Conway, this come in violation of the Constitution's appointments clause.

'The rule of law is disappearing before our eyes, ' tweeted former deputy attorney general Sally Yates, who was the first senior figure fired by Trump.

Earlier on Wednesday, Mr Trump denied he would shut down Mr Mueller's team, but still labelled the investigation an illegal "witch hunt" that had spent "millions" of dollars.

While Whitaker is now Mueller's ultimate supervisor, it was not immediately clear whether that meant Rosenstein would step aside.

In piercing attacks, Trump called Sessions weak and beleaguered. He'll likely be remembered as the worst Attorney General in American history.
