When asked about the role of the Muslim Brotherhood in the events of the 25 January, Mubarak repeated that he needed the permission from the president and the commandership of Egyptian Armed Forces to speak on the matter.

Earlier the same day, Mubarak had appeared in court to testify at the retrial of his successor, Mohamed Morsi, who faces charges of participating in a mass jailbreak in 2011.

In June 2013, anti-Morsi protests swept the country and the military gave the political parties in the country three days to meet the demands of the protesters calling for Morsi to leave power. It was the first time the two former leaders had confronted each other. The 90-year-old Mubarak testified in a retrial of Mohammed Morsi. His lawyer, Farid al-Deeb, had told the Cairo Criminal Court that the former president was a member of the military and that he had to obtain permission from the military to appear in court.

The 90-year-old Mubarak, whose almost three-decade rule was ended by a popular uprising in 2011, entered the courtroom with his two sons Alaa and Gamal.

At the time, authorities also cut off internet access and mobile phone networks, crippling communication among the protesters and with the outside world.

Mursi and other top Brotherhood officials had been sentenced to death in the initial trial, but his appeal of the verdict was accepted by the highest appeals court and a retrial was ordered. They are accused of storming prisons during the 2011 uprising that toppled Mr Mubarak.

Mr Morsi was dressed in prison overalls and seated in a thick glass and metal cage running down one side of the courtroom, like other senior figures of the Brotherhood who are defendants in the case.

In his testimony, Mubarak said he received information from the then-intelligence chief Omar Sulaiman that 800 militants entered the country on 29 January using smuggling tunnels along the border with the Gaza Strip and were involved in prison breaks and violence in Cairo's Tahrir Square, the epicentre of the revolution.

Mubarak was freed last year, ending almost six year of legal proceedings against him.

Mubarak has already served a three-year sentence for embezzling state funds while in detention in connection with the protesters' case.

Morsi, who was in a white jumpsuit, refused to question Mubarak.

Muslim Brotherhood leader Mohammed el-Beltagi, a defendant in the case, questioned Mubarak but was sentenced to two years in prison for insulting the judiciary after the chief judge said el-Beltagi ridiculed the court's decision to stop him from asking more questions.
