He had already been charged for under-reporting his income for the five years through 2015.

He may be accused of understating his salary from 2015 to 2018, three years more than the original charge that he under-reported some five billion yen ($44 million) in income over five years from 2010.

He is also under investigation for allegedly seeking to pass off personal investment losses to Nissan's books and paying a Saudi businessman from company funds to stump up collateral to cover the losses.

But even Ghosn's lead lawyer Motonari Otsuru believes that it will be "very difficult" to secure bail if his client is formally charged over this third allegation.

Otsuru said his team was applying for bail to release Ghosn, who has been detained since his November 19 arrest.

And that, he said, could take at least six months.

Ghosn's lawyers had appealed to the court to free him, claiming at a special hearing in a Tokyo court there were no grounds for his detention, which has now lasted more than 50 days.

According to reports, Ghosn was led into the court in handcuffs and with a rope around his waist, and appeared notably thinner than previously.

He spoke in a strong voice and passionately declared a "genuine love and appreciation for Nissan", saying he had acted "honorably, legally and with the knowledge and approval of the appropriate executives inside the company". The judge, Yuichi Tada, said it was because he was considered a flight risk, and the possibility of concealing evidence.

The Tokyo District Court on Wednesday dismissed his lawyers' request to end the detention and also rejected on Thursday their complaint filed against the decision.

The case is also being played out in local media, with another string of allegations leaking out in the Japanese press on Friday.

Ghosn's prolonged detention has put the spotlight on Japan's justice system, which has come in for some global criticism.

Another member of the legal team told Reuters that they would apply for bail after Ghosn's current detention period ends on Friday, but that his release would come on Tuesday at the earliest should the court accept the application.

And with each formal charge, prosecutors can hold Ghosn for two months of pre-trial detention, which is renewable.

The jet-setting high-flyer who once sparked criticism for a lavish lifestyle was initially kept in a tiny cell and slept on Japanese-style tatami mats.

This week he suffered a fever that prompted prosecutors to suspend their interrogations, though his lawyer said Friday that Ghosn's temperature had gone back down.
