Mark Herring and Democratic Attorneys General appeal Obamacare Ruling

U.S. District Judge Reed O'Connor recently declared the Affordable Care Act unconstitutional because the tax penalty for not buying health insurance was removed by the Tax Cuts and Jobs Act of 2017. The blue states filed a notice of appeal Thursday, the first formal step in bringing their challenge to the 5th Circuit Court of Appeals.

"Our goal is simple: to stand up for the law of the land - the Affordable Care Act - in order to keep health care affordable and accessible for millions of Americans", Becerra said in a statement.

"This shouldn't be a debate; the ACA has been the law for almost a decade and is the backbone of our healthcare system", he said.

"This case impacts almost every American", Becerra said.

Republicans mounted a concerted effort to overturn the Affordable Care Act a year ago but were unable to do so. The decision has been stayed pending appeal.

"We will fight to protect the law, protect the rule of law, and protect people who depend on this protection", Weiser said, adding that Medicaid expansion under the ACA has been a critical lifeline to rural hospitals in the state.

Rosenblum said uninsured rates have dropped in OR from 17 percent to 5 percent because of the ACA.

"We may be a relatively small state, but we have played an active role here in OR to protect our people's health care", Rosenblum said.

The security breach will mean the end of the road for the Starwood Reservations system at the center of the hack. The 2017 Equifax hack affected more than 145 million people.

It is clear that the 2010 Congress believed the individual mandate was essential, as Judge O'Connor says, but it's nonsense to contend that under the new Congress, the individual mandate can be both completely ineffectual and "essential" at the same time.

In April, AG Healey joined a coalition of attorneys general in filing a motion to intervene in the lawsuit to protect the ACA, arguing that it endangers health care coverage and funding for all Americans, particularly more vulnerable groups like seniors, children, and people with chronic medical conditions or disabilities.

That appeal, already promised by 16 states and the city government of Washington, D.C., is challenging the December 14 decision in Fort Worth.

Politically, the development may temporarily move the national spotlight off President Trump's expanding legal difficulties from the Mueller investigation on the Russian conspiracy to influence USA elections and the president's spreading business troubles. John Cornyn, R-Texas, is active in the conservative Federalist Society, according to the Texas Tribune.

After two long years of fruitlessly trying to kill Obamacare, the Republican Party and President Trump have been given a political hand grenade by a federal judge in Texas to get the job done.

In their conference call Thursday, the Democratic attorneys general disputed that. The current lawsuit claims that the zeroing out of that "tax" means that constitutional underpinning of the entire law is removed. That ruling struck down one specific provision of the ACA and, based on the nullification of that one section, held that no other part of the law could survive without it. That is the appeal in which the House will shortly ask the Fifth Circuit to allow it to join.

"There is a whole new day starting today, and I think it remains to be seen what role Congress will have", Rosenblum said.
