Prosecutors also filed charges Friday against Nissan and Ghosn aide Greg Kelly over the additional three years of under-reporting pay.

Ghosn, 64, says he's innocent. In a statement, Nissan stated that Munoz had "elected to resign" from the company, effective immediately. He was indicted Friday for acts including temporarily transferring personal trading losses to Nissan in 2008, as well as for understating his compensation for three years through March 2018. He was later indicted, along with Kelly and Nissan itself, on suspicion of withholding millions of dollars in income from Nissan financial filings between 2011 and 2015, when he was both chairman and chief executive of the company.

The scandal has sent shockwaves through the automotive industry and has escalated tensions between Nissan and Renault, where Ghosn remains CEO and chairman.

Kelly is also facing prosecution in Japan along with Ghosn, who has been fired by Nissan and Mitsubishi, following their arrests in November. Saikawa has not been accused of any crime.

One of Nissan Motor's top executives has resigned, further rattling the Japanese automaker's management group as it expands an investigation into ousted Chairman Carlos Ghosn's supposed financial misconduct. Nissan does not in any way tolerate such misconduct and calls for strict penalties. If the bail application is rejected, Ghosn will spend at least another two months in jail, a detention period that can then be extended by the court for a month at a time. After that, prosecutors are entitled to request one-month extensions. "In general in such cases in Japan, it is indeed the case that bail is not approved before the first trial does take place", he said, adding that it could be six months before the case comes before a judge.

Still, "until suspects admit to their crimes, they are usually held", Gohara said. His lawyer, Yoichi Kitamura, said he had rented an apartment on his client's behalf. Prior to the charge being laid, Nissan filed a criminal complaint based on the same violation against Ghosn with the Tokyo District Public Prosecutors Office. "We are fearful and very anxious his recovery will be complicated while he continues to endure such harsh conditions and unfair treatment", she said.

His wife Carole Ghosn issued a statement overnight out of Paris, expressing concern over his sickness. It refused to provide information. "We are fearful and very anxious his recovery will be complicated while he continues to endure such harsh conditions and unfair treatment".

Carlos Ghosn could spend the next year in a Tokyo jail awaiting trial after he was indicted for the second time since his arrest almost two months ago.

Ghosn's lawyers have argued that the deferred amounts were not fixed commitments and did not need to be disclosed. He denies any wrongdoing.
