Judge orders trial in Colorado woman's death

Frazee had allegedly told Kenney that Berreth was a "terrible mother" who had drug and alcohol problems and had physically abused their daughter.

Investigators said Berreth's cell phone pinged off a tower near Kenney's Idaho home, and police were led to Kenney by Frazee's cell phone records that showed his calls to her. When Kenney arrived at Berreth's townhouse in Woodland Park, Colorado two days later, she found a "horrific" scene with blood spattered on the walls and floors of Berreth's townhome, Slater said.

Berreth was last seen in public on November 22, when a security camera captured her entering a grocery store with her one-year-old daughter, Kaylee, in the mountain town of Woodland Park, Colorado, 90 miles (145 km) southwest of Denver.

Kenney told police she wanted to please Frazee and feared that he would harm her or her family if she did not cooperate, Slater said.

Teller County District Judge Scott Sells ruled there was sufficient evidence to bind Frazee over for trial, and set an April 8 arraignment date for him to enter a plea.

Kenney told police that Frazee convinced Berreth to wrap a sweater around her head and guess the scent of various candles then beat her to death with a baseball bat and stashed her body on a ranch.

Dramatic testimony on Tuesday revealed that Kenney admitted beginning a romantic relationship with Frazee in March 2018 and that Frazee tried to convince Kenney to kill Berreth. Blood in the bathroom identified as Berreth's was discovered December 6, days after police turned the property over to her family.

Berreth's brother, Clinton, had alerted investigators on December 4 to blood in her bathroom and evidence of attempts to clean it, Slater testified.

The first witness Tuesday was Frazee's mother, Sheila, who invoked her Fifth Amendment rights.

Frazee is suspected to be the last person that saw her alive. He said he was going to "give her space". "The fact that she came forward means she was cooperating fully with investigators", Decker said.

Woodland Park Police are offering a $25,000 reward for information that helps them find Berreth.

The filings also state that "Frazee had the motive to kill Kelsey in that he wanted full custody of KB or Kelsey to leave KB with him and Kelsey would not agree".

FOX31 will have a crew inside the courtroom Tuesday for the preliminary hearing.

Records tracked the nurse's phone near Berreth's apartment, and surveillance video showed the nurse and Frazee together at a gas station near his home as he filled a 5-gallon gas can on November 24. FOX31 legal analyst Chris Decker said it is a chance for prosecutors to detail "the four cornerstones" of their case against Frazee.

The update was made to a January wrongful death lawsuit filed by Cheryl-Lee Ellen Berreth and Darrell Lynn Berreth.

The parents grew concerned after the 29-year-old didn't respond to calls or texts for a week. Gooding is roughly 800 miles northwest of Woodland Park.

As the civil case moves forward, the criminal cases involving Frazee and a woman from Idaho have taken some unexpected turns.

When Cheryl pressed Frazee for details about her daughter's whereabouts, he suggested that "Kelsey may have flown somewhere with a friend or co-worker".

According to the lawsuit, Frazee told Cheryl-Lee Berreth that he and Kelsey broke up on Thanksgiving, and that "Kelsey agreed to share with Frazee 50/50 custody of their daughter".

Frazee is charged with murder and solicitation to commit murder. The next day, Berreth's phone pinged in Utah and then in Idaho. One is that he acted alone to kill Berreth; the other is that he - either alone or with other people - killed her during a robbery.
