"Empire" actor Jussie Smollett was arrested in Chicago early Thursday morning for allegedly filing a false report of a crime, police said.

According to Chicago Police spokesman Anthony Guglielmi, Smollett is under arrest following buzz about him possibly staging last month's horrific assault.

The actor is facing a felony charge for allegedly filing a false police report.

Jussie could face up to three years in prison if he is found guilty, but his lawyers have vowed to "mount an aggressive defence" against the charge.

A police spokesman says authorities are trying to negotiate Smollett's surrender.

After the charge was issued, the actor's attorneys released a statement saying they meant to "conduct a thorough investigation and to mount an aggressive defense".

Two brothers, who are bodybuilders and aspiring actors, have claimed they were paid to stage an attack on Smollett.

The announcement of the charges followed a flurry of activity in recent days, including lengthy interviews of the brothers by authorities, a search of their home and their release after police cleared them.

The Osundairo brothers were set to have their testimony officially documented before a grand jury but Smollett's legal team presented information to prosecutors to delay the brother's testimony, sources told Fox News.

One of the men had appeared in Empire, police said, and one of them was Smollett's personal trainer, who had helped the actor as he prepared to appear in a music video.

Jussie Smollett has been taken into custody. Commander Emanuel Gonzalez would say, if you see him shoot him on sight.

20th Century Fox Television and Fox Entertainment previously denied the star will be written out of his role as Jamal Lyon entirely. House Speaker Nancy Pelosi, D-Calif., deleted a tweet that referred to the alleged attack as "an affront to our humanity".
