The US Immigration and Customs Enforcement (ICE) says the musician is a British national who is in the country "unlawfully" after legally moving to the country on a now-expired visa in 2005, and that he is also a "convicted felon".

The Atlanta-based rapper was arrested on Sunday morning after ICE agents pulled over a auto, in which he and three other people were travelling.

WSBTV reports that an email from the ICE spokesman offered further explanation. "Mr. Abraham-Joseph initially entered the USA legally in July 2005, but subsequently failed to depart under the terms of his nonimmigrant visa".

Cox said that 21 has been placed in "removal proceedings before the federal immigration courts".

The rapper's lawyer, Dina LaPolt told TMZ his legal team was working towards getting 21 Savage out of detention, describing the allegations as a misunderstanding. In 2006, after almost 15 years of court proceedings, Rick was granted a full and unconditional pardon on the attempted murder charges by New York Governor David Paterson.

Instead of focusing on the legal issues involved with an expired visa or the potentially unconstitutional behavior of ICE, the internet reacted in an expected way - creating 21 Savage British memes.

Bryan Cox told American media that the rapper is actually a British citizen who came to the U.S. on a legal visa in July 2005 at the age of 12 and overstayed for the next 14 years. In December, he scored his first No. 1 on the Billboard charts for his latest album, "I am greater than I was".

ICE is reportedly waiting for the outcome of his case before a judge before any additional actions are set in motion.

The rapper was convicted of felony drug charges in 2014, Cox said.

"Free 21", Rapper Meek Mill tweeted after news of the arrest spread.

He is now 26 years old, which would suggest that Abraham-Joseph was around 12 when he arrived in America.
