Woman involved in texting suicide case finds out start date for her sentence

Michelle Carter was taken into custody at the end of a brief hearing before the Taunton Trial Court Monday afternoon.

Carter was jailed Monday on an involuntary manslaughter conviction.

Michelle Carter, 22, was taken into custody Monday (local time) to begin serving her 15-month sentence now that the state's highest court has upheld her involuntary manslaughter conviction. She has remained free as she appealed her conviction, which was upheld in Massachusetts Supreme Judicial Court last week. "48 Hours" covered the case in the episode, "Death by Text".

"As the defendant herself explained, and we repeat due to its importance, '[The victim's] death is my fault like honestly I could have stopped him I was on the phone with him and he got out of the [truck] because it was working and he got scared and I f-king told him to get back in, '" the court wrote in its decision.

The DA's Office had filed a motion last week for the trial court in Taunton to revoke the stay of sentence and have the 15-month jail sentence imposed.

Her lawyers said they will now take Carter's case to the Supreme Court.

Conrad Roy met Michelle Carter while their parents were on holiday in Florida. Their relationship consisted mostly of texting and other electronic communications. Both teens struggled with depression. He had made previous suicide attempts before he took his own life.

"After she convinced him to get back into the carbon monoxide filled truck, she did absolutely nothing to help him: she did not call for help or tell him to get out of the truck as she listened to him choke and die", Supreme Judicial Court Justice Scott Kafker said, reported Fox News.

Her case garnered global attention and provided a disturbing look at teenage depression and suicide. "Like I don't get why you aren't", Carter wrote in a text.

She also told him that he is "finally going to be happy in heaven". No more pain. It's okay to be scared and it's normal. She texted him on the day he died: "You keep pushing it off and say you'll do it but u never do".

The judge said Carter had a duty to call the police or Mr Roy's family, but instead listened on the phone as he died. The case hinged on text messages between the two in which Carter urged Roy to kill himself.

But the court rejected Carter's argument that she's being punished for protected free speech.

In the February 6 ruling, the state's highest court ruled that Carter "helped plan how, where, and when" Roy would kill himself.
