Indian SC orders protection for Kashmiris in wake of Pulwama attack

The National Human Rights Commission or NHRC on Thursday issued notices to the Union ministries of Home and Human Resource Development, and the state governments of West Bengal, Uttarakhand and Uttar Pradesh, seeking reports over "ill-treatment of Kashmiris" in wake of the Pulwama terror attack.

Gonsalves, appearing for petitioner, submitted that fresh attacks on Kashmiris have taken place in Maharashtra and Punjab. Condemning the rising incidents of lynching cases in India, the Supreme Court had, in 2018, instructed Parliament to come up with a new law which would deal with such offences.

"The Centre has already issued advisory to all states and Union Territories on 17 February but we can't tell the states about their specific actions that can be taken in such cases because law and order is a state subject", the AG added. He informed the court that the phone numbers of the government-appointed nodal officers entrusted with ensuring the safety of Kashmiri students will be circulated, reported CNN-News18. The appointment of such nodal officers have to be given wide publicity, the Bench stated.

Taking a "serious note" of media reports regarding attack on Kashmiri people, including students studying in various institutes at different places in the country, it has observed that the reports, if true, raise serious issue of violation of human rights.

Gonsalves has filed the plea on behalf of petitioner Tariq Adeeb.

The petition has arraigned eight states and the Central government as respondents.

More than 700 Kashmiri students, workers and traders have returned to occupied Kashmir from the rest of India to escape reprisals for the attack, which has also ratcheted up regional tensions after India has alleged that those who planned the attacks had links with the Pakistani state - a charge that Islamabad has vigorously denied.

Meanwhile, Omar also criticized the PM Narendra Modi for not speaking against the alleged harassment of Kashmiri people in various parts of the country.

Specifically, the petition prays for directions to be issued to heads of institutions including educational institutions to take steps to protect the lives of Kashmiris.
