The status of prisoner of war can be applicable only in an worldwide armed conflict.

Pakistan has already violated the Geneva Convention by videoing Wing Commander Abhinandan in injured and blindfolded condition.

Wing Commander Varthaman is a member of the armed forces of a Party to the conflict - being an officer of the Indian Air Force - and therefore falls within this definition of a prisoner of war.

There has been no "declaration" of war, with neither state indicating this. Earlier in the day, the Ministry of External Affairs had said that a Mig-21 had been lost while a pilot was missing after Indian forces engaged with intruding Pakistan Air Force jets, shooting one down.
