Still, this latest move by Huawei has simply ratcheted up the pressure. Last Friday, it filed suit against the Canadian government for allegedly violating the rights of Huawei chief financial officer Meng Wanzhou when officials arrested her in Vancouver in December on an extradition order from the U.S.

Her lawyers argued Tuesday that it will take time to develop her defense in part because of political issues and comments by U.S. President Donald Trump.

Guo said the United States government had "mislead the American public" regarding Huawei and "never presented evidence" regarding its allegations against the company.

"This ban not only is unlawful, but also restricts Huawei from engaging in fair competition, ultimately harming U.S. consumers".

Guo suggested the USA campaign to contain Huawei was prompted in part by the US's belated realisation that the company had become a rival to American tech leaders.

"[You need to] realize that companies like Huawei and ZTE are wholly subsidiaries of the Chinese Communist party and therefore we have significant concerns about the extent to which they are able to infiltrate our domestic industry here", said Republican Congressman from Wisconsin Mike Gallagher.

Huawei claims the USA statute blocking Huawei equipment from developing 5G networks hinders competition and hurts the economy.

In a statement, the firm said the US Congress has "failed to produce any evidence to support its restrictions".

Washington has pressured other countries to limit use of its technology, warning they could be opening themselves up to surveillance and theft of information.

Huawei said the case was filed in a US District Court in Plano, Texas, challenging what it called an "unconstitutional" 2019 defence bill that prevents government agencies from buying its equipment, services, or working with third parties that are Huawei customers.

The lawsuit also alleged that Huawei had been denied due process and that Congress, by stripping Huawei of commercial opportunities, violated the "separation of powers" portion of the constitution by doing the work of the courts.

After Manning refused to testify, Judge Hilton remanded the former intelligence analyst to the custody of the U.S. During the hearing, the judge would weigh the legality of her refusal to answer questions before the grand jury.

"Huawei is not owned, controlled, or influenced by the Chinese government".

The U.S. Department of Justice has laid out 13 criminal counts of conspiracy, fraud and obstruction against Huawei and Meng, who is the daughter of company founder Ren Zhengfei.

The legal challenge comes down to an addition to the National Defense Authorization Act (NDAA), which President Donald Trump signed previous year.

The Canadian court timetable suggests that the Huawei extradition battle could linger beyond the ongoing U.S. "The NDAA law can only impair Huawei's long-term commitment to invest more and hire more here".

"I don't see how (Huawei) can really escape that result", said Schwinn.

After years of relatively meek responses to worldwide criticism, Huawei's lawsuit is part of a significantly stepped-up public relations and legal counteroffensive in recent months.

Meng and her legal team maintain that she's done nothing wrong.

Huawei's 54-page complaint can be found here [PDF]. The indictment accuses Huawei and Meng of misrepresenting their ownership of a Hong Kong-based subsidiary between 2007 and 2017 in an effort to circumvent US sanctions against Iran.

Two affiliates also have been charged with stealing trade secrets from telecommunications group T-Mobile.

Days earlier, Canada authorised a hearing for an extradition request, quashing Chinese hopes of a rejection on grounds that Meng's arrest was politically motivated.

Canadian citizens Michael Kovrig, a former diplomat and now an analyst with Brussels-based worldwide conflict monitoring think-tank Crisis Group, and Michael Spavor, a businessman and consultant, were detained after Meng's arrest.
