Adnan Syed's Conviction Reinstated, So 'Serial' Subject Won't Get New Trial

Maryland's Court of Appeals has ruled that Adnan Syed, whose murder conviction was the focus of the first season of the popular "Serial" podcast, will not get a new trial.

The state appealed that ruling a second time on the grounds that the lower court was wrong to find that Syed previously had an ineffective defense counsel.

But the state's supreme court ultimately decided against it, with an order to reverse the judgment by the Baltimore City Circuit Court.

Syed received a life sentence for Lee's 1999 slaying and burying her body in Baltimore's Leakin Park.

The defense's case was detailed in Sarah Koenig's 2014 "Serial" podcast and will be revisited in an HBO docuseries called "The Case Against Adnan Syed" that premieres Sunday, according to NBC News. He wrote on Friday that they won't give up, but also voiced frustration with the 4-3 ruling. The obstacles to getting a new trial are simply too great, " Brown said. Syed's attorney, Justin Brown, tweeted after the opinion was released. The show revealed little-known evidence and attracted millions of listeners, shattering podcast-streaming and downloading records. "There was a credible alibi witness who was with Adnan at the precise time of the murder and now the Court of Appeals has said that witness would not have affected the outcome of the proceeding". Hotten agreed with the majority's conclusion that Syed's trial counsel's failure to investigate McClain as a potential alibi witness constituted deficient performance, but she wrote that she believed the deficiency "was prejudicial against Mr. Syed".

Before the 1999 trial, the defense claims that Syed asked Gutierrez if she had reached out to Asia McClain, to which Gutierrez responded that nothing had come of it. "We go down a lot of interesting paths that I think you'd need the visual medium to explore", Berg said.

"From the perspective of the defendant, there is no stronger evidence than an alibi witness", Brown said on Friday.

McClain said in an affidavit she had seen Syed in Baltimore's Woodlawn Public Library around the time prosecutors say he strangled Lee.
