Neal is relying on a 1920s-era law that says the IRS "shall furnish" any tax return requested by the chairmen of key House and Senate committees.

In his letter, Consovoy said that Neal "cannot legally request" the information as the tax code guards taxpayer privacy with the exception of certain conditions - which he says are not met. But on Saturday, he said the administration would respond by the latest target date. "Indeed, the Supreme Court has consistently noted that the motivations underlying Congressional action are not to be second guessed, even by the courts".

The Treasury Department has missed a deadline to deliver President Donald Trump's tax returns to the House Ways and Means Committee chairman.

Last week, the acting chief of staff, Mick Mulvaney told Fox News Sunday that Democrats will "never" see Trump's tax returns. If the U.S. Treasury Department denies requests from Congress for the president's federal tax returns, they would at least have a chance of getting his state returns.

A lawyer for President Trump likened the request to "harassment". He claimed - and has continued to claim - that he could not make his tax returns public because they were under audit by the IRS.
