Foxx texted Joseph Magats, her top deputy whom she put in charge of the Smollett case after recusing herself, the day a grand jury handed up the 16-count indictment against Smollett to make an unfavorable comparison to the counts against Kelly filed just weeks earlier.

She wrote: "So... I'm recused, but when people accuse of overcharging cases..."

Kim Foxx's office dropped all charges against the actor in March who was accused of lying about being the victim of a hate crime.

Just over two weeks later on March 26, prosecutors announced they would drop all charges against Smollett - though Magats admitted "I do not believe he is innocent".

The messages were among almost 200 pages of screenshots of texts exchanged between Foxx and her top staff, included alongside more than 3,600 pages of emails - and a 36-page spreadsheet detailing records the office determined could not be released to the public because records in Smollett's case were sealed the day the charges were dropped.

Other texts showed prosecutor were blindsided by the response they got following their decision to drop the charges.

Prosecutors, last month, argued that Foxx never formally recused herself amid questions over her office's decision to drop the charges against Smollett.

She later said she didn't recuse herself in the legal sense of the word, because there was no actual conflict, but simply separated herself from the case out of an abundance of caution.

"There's really no planning for this", Magats responded.

"It appears as if Jussie's press person may have notified the press", Lanier texted three spokespeople on the morning the case was dismissed. She said Johnson seemed "satisfied" with her explanation that Smollett had completed community service and turned over his $10,000 bond money to the city. 'He said that I can ask any question I wanted.

In that same op-ed she said she'd "welcome an outside, nonpolitical review of how we handled this matter".

About 10 minutes later, Foxx texted Magats: "Eddie just called".

The texts were included in thousands of pages of texts and emails related to the Smollett case released by the State's Attorney's Office late Tuesday.

Smollett found himself at the center of an worldwide media firestorm after he reported being the victim of a January 29 attack by two people who shouted slurs, hit him and wrapped a noose around his neck. Apparently he's coming in to represent the Nigerian brothers in Smollet.

After the charges were dropped, Foxx went on the offensive.

It all comes after Smollett's alleged hate crime hoax and in light of him being sued by the city of Chicago after he failed to pay $130,106 for what he cost the city investigating the alleged hoax.

Johnson, though, was furious over the decision and publicly blasted it - along with Mayor Rahm Emanuel.

Inspector General Patrick Blanchard will be conducting an investigation of how Foxx's office handled the case.
