A suburban Detroit man who was in the middle of a divorce when he won more than $30 million must share the lottery windfall with his ex-wife.

After taxes and deductions, Rich Zelasko's Mega Millions winnings amounted to $38,873,628, according to court documents.

According to the Associated Press, Rich Zelasko had been separated from his wife, Mary Beth Zelasko, for two years when he won a $30 million lottery ticket in 2013. Their divorce was finalized in 2018, the Free Press reports.

The arbitrator John Mills - who was granted the ability to make some decisions in the case by the couple - determined that Dick's lottery winnings were "part of the marital estate" and likely not his first purchased ticket.

Zelasko had fought the arbitrator's decision since 2013, but Mills recently passed away and Zelasko tried to void all the decisions made by the deceased arbitrator.

The couple were married in 2004 and have three children.

The appellate court said it found no errors that would require it to change the award. "We believe the arbitrator violated controlling MI law when he awarded Mrs. Zelasko half of the $30 million net lottery proceeds".

The Daily Mail reports court documents detail comments by Elizabeth claiming she was the breadwinner in the marriage, earning an income in the range of $100,000 to $120,000 compared to Zelasko's income of $36,000.
