Ex-FBI Deputy Director Faces Prospect of Criminal Charges

DOJ Rejects McCabe's Arguments That He Shouldn't Be Charged

The potential charges relate to McCabe's allegedly misleading FBI investigators about his role in the leaking of classified information related to the Hillary Clinton email investigation.

They also note the interviews took place during a chaotic and tumultuous time as McCabe was preoccupied by his leadership duties at the FBI and its investigation into potential ties between Russian Federation and the Trump campaign.

A USA attorney for Washington D.C. has recommended going forward with criminal charges against former FBI Acting Director Andrew McCabe, following a scathing Inspector General's report on his conduct during the Clinton email probe.

After he was sacked by Attorney General Jeff Sessions in 2018, McCabe set up a GoFund me page and received more than $500,000.

McCabe's attorneys have argued that he should not face charges on accusations that he lied to internal investigators about whether he had authorized a news media leak related to an investigation of the Clinton Foundation in the fall of 2016.

Two people familiar with the matter said Thursday that the deputy attorney general declined an appeal from McCabe's lawyers aimed at preventing a prosecution.

Last year McCabe was referred to the U.S. Attorney for criminal charges by the Department of Justice Inspector General Michael Horowitz. However, we concluded that McCabe's decision to confirm the existence of the CF Investigation through an anonymously sourced quote, recounting the content of a phone call with a senior Department official in a manner created to advance his personal interests at the expense of Department leadership, was clearly not within the public interest exception.

Mike 'The Situation' Sorrentino released from prison
In a statement to Entertainment Tonight , Sorrentino and his wife Lauren said they are elated to close this chapter of their life. Sorrentino pleaded guilty to one count of tax evasion in January 2018 for not fully paying the amount of taxes he owed for 2011.

Lastly, we determined that as Deputy Director, McCabe was authorized to disclose the existence of the CF Investigation publicly if such a disclosure fell within the "public interest" exception in applicable FBI and DOJ policies generally prohibiting such a disclosure of an ongoing investigation.

In campaign speeches, interviews and tweets, Trump has accused McCabe of conflicts of interest because his wife Jill McCabe, a Democrat, received donations for an unsuccessful 2015 Virginia state senate campaign from a Clinton ally.

His termination came 10 months after the firing of FBI Director James Comey, who at the time was leading the bureau's investigation into Russian interference in the 2016 US presidential election and whether anyone associated with President Donald Trump's campaign conspired in the operation.

He sued the Justice Department in August, saying officials had used the inspector general's conclusions as a pretext to rid the Federal Bureau of Investigation of leaders Trump perceived as biased against him. Trump had been critical of McCabe while he was still at the Federal Bureau of Investigation, and McCabe had been fired just hours before he would have been eligible to retire from the Federal Bureau of Investigation with full benefits.

Last month, McCabe sued the DOJ over his firing last spring, arguing the move was "politically motivated and retaliatory".

The article recounted a particularly tense phone call between McCabe and a senior Justice Department official about the investigation.

The Justice Department declined to prosecute Comey after the Inspector General's office found that he had improperly handled memos he wrote about his one-on-one meetings with Trump before he was sacked.
