US District Court rejects lawsuit trying to block T-Mobile-Sprint merger

"There are important nuances related to T-Mobile and Sprint that many observers miss, and the likely impact of Dish on the Towers may not be as dramatic or realized as quickly as many hope", wrote Craig Moffett.

In the ruling, US District Judge Victor Marrero of the Southern District of NY said Sprint was not a major player in the competitive field in the wireless industry on its own, and that Sprint didn't posess "the financial and operational means to survive in the near term as a national wireless carrier".

New York's attorney general said the state is considering an appeal; California's attorney general said that state is "prepared to fight".

With the merger approved, however, they expect T-Mobile to aggressively deploy Sprint's 2.5 GHz spectrum and largely offset any slowdown from the pause over the past several months. They sued in June 2019, even before the merger was approved by the U.S. Department of Justice and the Federal Communications Commission.

T-Mobile and Sprint had been the most aggressive USA wireless companies in terms of price competition in recent years, forcing AT&T and Verizon to follow moves like ending service contracts and adopting unlimited data plans.

Sprint and T-Mobile have won a major lawsuit in their quest to merge. T-Mobile disagrees, promising that it will spin-off $5 billion worth of assets to Dish Networks, who will create a fourth wireless provider as competition. After the ruling, T-Mobile announced that it's beginning the "final steps" to complete the merger, and Sprint's stock is up over 70% at the time of writing.

Four of them raised considerations with the National Labor Relations Board, which is now conducting an investigation. Naughton said he would work with Pichai and financial director Ruth Porat to find a successor.

The $26 billion deal can finally move ahead, which should lessen uncertainty for the two company's stocks. Under a previous deal between Dish and the DOJ and FCC, the company had a deadline this year to build a narrowband internet of things (IoT) network connecting "people and sensors and microprocessors".

Letitia James, the AG from NY, said in statement the reduced competition is "bad for consumers, bad for workers, and bad for innovation".

Shares of Dish were up more than 6% on the judge's ruling. They also said the deal wouldn't work out as planned because Dish was unlikely to be able to follow through on its commitments to become a viable wireless competitor.

"While the mobile cores of traditional networks require large amounts of hardware that are costly to install and maintain, Dish plans to construct a "virtualized network" that relies more heavily on software and cloud-hosting services provided by potential partners like Amazon", the judge said in his decision. T-Mobile extended gains to as much as 8.4% to $91.88. The new carrier will have a new CEO in the person of Mike Sievert, who will take over from John Legere, T-Mobile's effervescent CEO who's largely been responsible for the revival of T-Mobile in recent years.

The U.S. mobile landscape is on track to look a whole lot different.
