Mark Geragos, Kaepernick's attorney, took to Twitter on Thursday to share a statement from arbitrator Stephen Burbank confirming the ruling.

Colin Kaepernick won the summary judgement phase of his collusion case on Thursday, a phase specifically requested by the National Football League in hopes of a dismissal, Yahoo's Charles Robinson reports.

In moving forward with his grievance filed against the NFL, Colin Kaepernick's legal team will reportedly seek federal subpoenas for President Donald Trump and Vice President Mike Pence to testify. "No Club, its employees or agents shall enter into any agreement, express or implied, with the National Football League or any other Club, its employees or agents to restrict or limit individual Club decision-making as follows: Whether to offer or not to offer a Player Contract to any player". The judge presiding over the case has ruled that Kaerpernick has indeed supplied sufficient evidence for the case to go to trial. The protests grew during the 2017 season with players protesting en masse.

Kaepernick contends the owners violated their collective bargaining agreement with players by conspiring to keep him off teams.

Or as one senior Labour source put it: "Frank has been looking for an excuse to resign for some time". Field, who supports Brexit, had already faced a vote of no confidence from his local party in July.

Kaepernick, who led the 49ers to the Super Bowl in 2013, left San Francisco at the end of the 2016 season and has not been picked up by a team since. The fact that teams with a need for a quarterback have passed up the chance to sign Kaepernick left many to believe owners are either punishing him for his stance or believe his presence would alienate fans.

Trump has repeatedly railed against National Football League players who kneel during the anthem during his time in office.

A similar grievance is still pending by unsigned safety Eric Reid, who played with Kaepernick in San Francisco and joined in the protests. Players are allowed to stay off the field during the anthem.
