Harvey Weinstein must face sex trafficking lawsuit brought by British actress

The judge gave the thumbs-up Tuesday to the suit, which was filed by aspiring British actress Kadian Noble, claiming that the "Shakespeare In Love" producer violated federal laws against sex trafficking when he lured her to his Cannes, France, hotel room with false promises of an acting role for the goal of sex.

Film producer Harvey Weinstein speaks to his lawyer Benjamin Brafman inside Manhattan Criminal Court during an arraignment in the Manhattan borough of NY, U.S., July 9, 2018.

Sweet, a US District Court Judge, claims the lawsuit filed by Kadian Noble is consistent with mandates ascribed by the sex trafficking laws as laid out by Congress.

Sweet wrote that though the case is "not an archetypal sex trafficking action", Noble had a plausible case that Weinstein may have broken the sex trafficking law.

British actor Kadian Noble, 31, sued Weinstein in U.S. district court in New York City in November, charging he brought her to a hotel room in France and sexually assaulted her. Weinstein's team of attorneys have claimed that "nothing of value was exchanged" when the disgraced producer supposedly molested her and forced her into a bathroom and then proceeded to masturbate while making her watch. We believe these claims are not legally or factually supported, and ultimately will not be sustained'.

The judge cited evidence that Weinstein had promised Noble a film role and said "everything would be taken care of".

Weinstein faces accusations of sexual misconduct, including rape, from more than 70 women, primarily from young actresses and women employed in the film industry.

Weinstein, who was one of the most powerful figures in Hollywood before the accusations surfaced in October, is separately facing criminal rape and sexual assault charges in Manhattan state court over allegations by three other women.

Weinstein, who has been accused by dozens of women, has denied engaging in non-consensual sex.

Weinstein's attorneys sought to have the lawsuit dismissed, arguing that the alleged incident did not fit the definition of a "commercial sex act" under the trafficking statute, because she was not offered a "thing of value" in exchange for sex.

Sweet said in Tuesday's opinion that Weinstein's promises were valuable to Noble and that his argument "does not reflect modern reality".

Noble charges that Weinstein invited her to his hotel room in Cannes, in the south of France, to review a film reel she had submitted and discuss a movie role he claimed to have in mind for her.

Nobel sued Weinstein past year, saying he set her up for an unwanted sexual encounter when they met in London, where he told her that "he had a role in mind for her and that 'it will be good for you'".
