US FDA Proposed Crackdown on Flavoured E Cigs Puts Juul on Notice

A former Trump campaign strategist says the Food and Drug Administration (FDA) commissioner has "lost his mind" after he threatened to take all flavored e-cigarettes off the USA market if retailers don't do more to control use among teens.

The use of e-cigarettes has become an epidemic among teens and needs to be stopped, Food and Drug Administration chief Dr. Scott Gottlieb said Wednesday. Since a year ago, FDA commissioner Scott Gottlieb and other federal officials have discussed e-cigarettes as a potential tool to ween adult smokers off cigarettes, although that benefit hasn't been proven.

"We see clear signs that youth use of electronic cigarettes has reached an epidemic proportion, and we must adjust certain aspects of our comprehensive strategy to stem this clear and present danger", Gottlieb told a news conference.

The five brands the FDA has addressed are: Juul, Vuse, MarkTen XL, blu e-cigs and Logic. But health officials have warned nicotine in e-cigarettes is harmful to developing brains.

Such a step would be a major blow to the e-cigarette companies - Juul, Vuse, Blu, Logic and MarkTen - which often feature cream and fruit flavorings in their products. It's one the newest forms of vaping to hit the e-cigarette market and it's made smoking quite popular among the younger, teen demographic. "Hindsight, and the data that's now available to us, fully reveal these trends".

Despite the fact that they can not legally be sold to anyone under 18, e-cigarettes - hand-held vaporizers that create aerosols from liquids typically packed with nicotine and other chemicals, often including flavorings - are now the most popular tobacco product among high school students, recent federal data shows.

The decision was criticized by anti-smoking advocates who say e-cigarette makers are targeting kids with candy flavors and marketing that portrays their products as flashy, hand-held gadgets.

Shares of Big Tobacco companies surged in trading today.

Shares of British American Tobacco were up almost 6 percent and shares of cigarette-maker Imperial Brands PLC were up more than 3 percent.

The statement also states that the agency issued 1,300 warning letters and fines to retailers who were caught illegally selling products to minors in "an undercover blitz of brick-and-mortar and online stores this summer".

A Juul spokesperson, Victoria Davis, argued in a statement to Reuters that "appropriate flavors play an important role in helping adult smokers switch". "This belief is based on not just the results of the agency's enforcement actions, but also recent sales trends, news coverage, increased concerns among kids, parents and educators, as well as preliminary data that will be finalized and released in the coming months".

"In my view, they treated these issues like a public relations challenge rather than seriously considering their legal obligations, the public health mandate and the existential threat to these products, and as they did, these risks have mounted", Gottlieb said. "And they [teens] have adopted it", Gould said.
