McClure, 28, and D'Amico, 39, created a GoFundMe page in November 2017, claiming the homeless, drug addict Bobbitt spent his last $20 to fill up McClure's empty gas tank after her vehicle broke down on I-95 near Philadelphia.

Prosecutors said that Mark D'amico and Kate McClure conspired with destitute Johnny Bobbitt to create the get-rich-quick scheme in 2017.

But prosecutor Scott Coffina was not done.

An investigation into the case was launched back in September.

Back in November of 2017, a homeless man named Johnny Bobbitt was said to have given his last $20 to a young woman named Katie McClure after her auto ran out of gas in Philadelphia.

Legal documents obtained by NBC Philadelphia say the trio deliberately withtheld information from donors, and then continued the ruse 'by failing to correct their story'. Bobbitt and the couple worked together to concoct the tale and gain sympathy and cash. More than 14,000 people raised more than $400,000.

The alleged scam began last August, when former Marine Bobbitt reportedly gave McClure $20 for gas after her vehicle ran out along an interstate in Philadelphia. The initial goal was $10,000.

The past year has been wrought with allegations of theft and wrongdoing between the parties, leading to more attention. Investigators say it was all a scam, according to WTXF.

An attorney for the couple said that $200,000 had gone to Bobbitt - but a superior court judge said that McClure and D'Amico had "misadvised " the attorney and there actually was no money left.
