FDA Says Juul Violated Regulations, Sold Vaping As Safer Than Smoking

The practice of vaping, or using e-cigarette devices, has gained popularity among young people in recent years, according to the CDC.

The warning letter identified several problematic statements made by a JUUL representative speaking at a school at an unspecified date, including that the product was "much safer than cigarettes" and that 'FDA would approve it any day.

The FDA action increases the legal pressure on the nation's top-selling vaping company, which has been besieged by scrutiny from state and federal officials since a recent surge in underage vaping. E-cigarettes generally heat liquid containing nicotine.

The FDA also sent Juul a letter requesting documents related to the company's advertising and promotional efforts, given that its vape devices "continue to represent a significant proportion of the overall use" of e-cigarettes by children. Juul halted much of its social-media marketing past year after criticism that its stylish ads on Instagram and other apps targeted younger users.

Reached for comment, a spokesperson for Juul said the company is reviewing the letter and plans to "fully cooperate".

Last week, The Washington Post reported that federal- and state- level scientists said they believe an oil derived from Vitamin E found in cannabis vapor may be responsible for the lung damage in numerous illnesses.

FDA regulators also asked Juul to turn over detailed information about its potent nicotine formula. The investigation has widened into 127 reports of seizures linked to various types of e-cigarettes.

Representative Raja Krishnamoorthi, an Illinois Democrat, wrote Sharpless last week urging the agency to look into the claims Juul has made, including some before his House Oversight and Reform subcommittee.

New acting FDA commissioner Ned Sharpless tells the Times this week, "Regardless of where products like e-cigarettes fall on the continuum of tobacco product risk, the law is clear that, before marketing tobacco products for reduced risk, companies must demonstrate with scientific evidence that their specific product does in fact pose less risk or is less harmful". A letter from the CEO posted on Juul's website also argued that Juul devices "deliver smokers the satisfaction that they want without the combustion and the harm associated with it", according to the FDA's statement. "They mean two very different things".

E-cigarettes have been on the USA market for more than a decade, but the FDA didn't gain the authority to regulate them until 2016. Altria shares were little-changed in NY trading Monday, trading at US$43.89 at 11:36 a.m.
