Unlike Brexit-related challenges against the government heard in England and Scotland, the Northern Ireland cases can not leapfrog straight to the Supreme Court following the High Court judgment.

But the judge said: "I consider the characterisation of the subject matter of these proceedings as inherently and unmistakably political to be beyond plausible dispute". Some 3,600 people died in the conflict.

McCord's lawyers said the judgment will be appealed and they will do "everything in our power" to get the case to the Supreme Court next week.

It comes after a legal challenge in Scotland found that Mr Johnson's decision to prorogue Parliament was illegal.

There is now uncertainty whether the Northern Ireland challenge can be heard in the Supreme Court next week.
