Trump niece book blocked by New York judge but lawyer promises appeal

A NY judge on Tuesday temporarily blocked the publication of Mary L. Trump's scathing book about President Donald Trump, her uncle, which describes him as the "world's most unsafe man", saying no copies can be distributed until he hears arguments in the case.

The original complaint in the case seeks specific performance by Mary L. Trump to shut down the publication of her book, breach of contract, and a declaratory judgment which would agree that Mary L. Trump's statements violate her settlement agreement with Fred C. Trump's estate.

Their settlement almost two decades ago included a confidentiality clause that explicitly states they would not "publish any account concerning the litigation or their relationship", unless all of them agreed, according to court papers.

Greenwald in Poughkeepsie, New York, issued an order requiring the niece, Mary Trump, and her publisher to explain why they should not be blocked from publishing the book: "Too Much and Never Enough: How My Family Created the World's Most Dangerous Man".

The order leaves it uncertain whether the book will be published as scheduled on July 28.

The second notice of appeal, filed by Mary L. Trump at 2:26 p.m., reads virtually identically but adds the issue of whether Robert S. Trump "has satisfied his burden to establish the factors of a temporary restraining order".

Boutrous said the order was "a prior restraint on core political speech that flatly violates the First Amendment".

In a statement from Mary Trump's lawyer, Mr Boutrous said: "President Trump and his siblings are seeking to suppress a book that will discuss matters of utmost public importance".

Robert's Trump lawyer, Charles Harder, cheered the ruling, saying that "the actions of Mary Trump and Simon & Schuster are truly reprehensible".

"Short of corrective action to immediately cease their egregious conduct, we will pursue this case to the very end".

"We plan to immediately appeal this decision to the Appellate Division, and look forward to prevailing in this case based on well-established precedents regarding prior restraint", the publisher said, according to the news outlet.

Robert Trump, the president's brother, filed a suit last week in NY in Queens County Surrogate court, where the estate of the president's father, Fred Trump Sr., was settled after his death in 1999. The first attempt, in Queens Surrogate's Court where the estate of the president's father was settled, failed when the judge said the outcome would not affect the administration of the estate "one iota".

Lawyers for Robert Trump quickly filed a claim in Dutchess County Supreme Court in upstate NY, where he lives.
