Judge Christen did not reach the constitutional claim that DHS acted because of Trump's racial animus, but she did note that there was significant evidence that Trump's bias affected the decisions, and stated that "we can not sweep aside the words" that Trump used and their troubling meaning.

A California appeals court on Monday gave the Trump Administration permission to end Temporary Protected Status for immigrants from El Salvador, Nicaragua, Haiti, and Sudan, clearing the way for officials to force more than 300,000 immigrants out of the country.

The case was first brought before the US District Court for the Northern District of California in early October 2018 after the Trump administration sought to terminate TPS status for immigrants from Haiti, Sudan, Nicaragua and El Salvador. The court concluded that "there is still no evidentiary support for the conclusion that this overarching goal was motivated by racial animus".

A district court previously issued a preliminary injunction.

The termination of TPS for Haitians is also subject to separate litigation in the 2nd U.S. Circuit Court of Appeals in NY.

But US Circuit Judge Morgan Christen, a President Barack Obama appointee, said in her dissent that the TPS terminations were reviewable and that they violated federal administrative law.

Many TPS beneficiaries have lived in the United States for decades-and have children who are USA citizens.

"This government has failed me and the other 250,000 USA citizen children of TPS holders", Ramos said in a statement.

The three judge panel, in a 2-1 decision, rejected arguments that the administration had failed to follow proper procedures and that the decision was tainted by racist comments from President Trump and others in his aides.

Beth Werlin, the executive director of the American Immigration Council, expressed disappointment with the court's refusal to acknowledge a connection between Trump's remarks and the administration's decision to end TPS.

"The racial animus that led to these decisions is real and can not be ignored", Werlin said.

In a statement, Werlin said the decision will "plunge their lives into further turmoil at a time when we all need greater certainty".

"Without Congressional action", warned Ibe, "this will lead to devastating moral and economic consequences not just for TPS holders but for their families, communities, and for the entire country".

The Center for American Progress, a nonprofit, nonpartisan and independent think tank, found in April that about 131,000 people working in the aforementioned essential industries were TPS holders.

Recipients of TPS are inextricably linked to our communities and our economy. "And, as the US responds to the COVID-19 pandemic, TPS recipients are standing shoulder to shoulder with Americans and doing essential work".

But how will it affect immigrant communities across the country?

"The country and our people cannot, should NOT be put through four more years of this incompetence, and destruction", Patrice Lawrence, Co-director of UndocuBlack, a group representing undocumented Black immigrants, said in part a statement emailed to NewsOne Monday night.

The Federation for American Immigration Reform, which advocates for lower levels of immigration, welcomed the ruling as "a victory for the American people and an unmistakable rebuke to activist judges who seek to make immigration policy from the bench".

"This ruling represents a win for the idea that the American people should be able to provide needed and appropriate temporary humanitarian relief, with the full expectation that their generosity will not be taken advantage of when the emergency is over", FAIR President Dan Stein said in a statement. A court order in NY forbidding the deportation of Haitians remains in place, and because of extensions granted during the lawsuit, TPS status for the countries can not be terminated until March of 2021, by which time we may have a new president.

While these programs have been continually renewed for decades in certain cases, the Trump administration has systematically dismantled them since 2017, citing their temporary nature.
