Congressional Democrats Reportedly Plan Bill to Expand Supreme Court

Some House and Senate Democrats are ramping up the political battle over the Supreme Court, introducing a bill Thursday to expand the court from 9 to 13 seats, a move many Republicans have rejected as risky "court packing".

Ed Markey of MA in the Senate, and Rep. Jerrold Nadler of NY, the chair of the Judiciary Committee, in the House.

Markey depicts the bill as necessary to neutralize the court's politicization by Republicans who refused to even consider the nomination of Merrick Garland, then a D.C. Circuit judge and now the USA attorney general, in an election year, only to discard that rationale by rushing the confirmation of Justice Amy Coney Barrett late last year to secure the high court's current 6-3 conservative orientation. Nadler argued that 13 is a "proper number" of justices because it matches the number of federal appellate circuits.

"Republicans stole the Court's majority, with Justice Amy Coney Barrett's confirmation completing their crime spree", Markey said in a statement. Contrary to commentary from conservatives, the Constitution does not specify the number of seats the nation's highest court should have, and this would not be the first time Congress has changed the size of the Court: it has been changed seven times before.

The bill's shutdown is just the latest play in a long-running divide between Ms Pelosi and the liberal wing of the Democrat party.

"Packing the court is an act of arrogant lawlessness", said Mike Lee, a Utah Senator.

Demand Justice, a key progressive group pushing to expand the court, strongly backed the Democrats' bill.

President Joe Biden announced last Friday the formation of a bipartisan commission to study potential Supreme Court changes including expansion or imposing term limits on the justices instead of the current lifetime appointments.

"This bill marks a new era where Democrats finally stop conceding the Supreme Court to Republicans".

"Our task now is to build a grassroots movement that puts pressure on every Democrat in Congress to support this legislation because it is the only way to restore balance to the Court and protect our democracy", he said.
