But not all of the equipment subpoenaed by the Senate has been returned - in a statement, county officials noted there are still 385 voting machines in the custody of the Senate's private contractors.

The official Twitter account of the Senate liaison for the Maricopa County audit tweeted a similar accusation that same day, saying: "Maricopa County deleted a directory full of election databases from the 2020 election cycle".

Secretary of State Katie Hobbs, a Democrat, said in a letter that Maricopa County lost control of the machines after they were handed over and doesn't know what was done to them.

"The lack of physical security and transparency means we can not be certain who accessed the voting equipment and what might have been done to them", she wrote, advising that the county "should acquire new machines to ensure secure and accurate elections in Maricopa County going forward".

"For that reason, Maricopa County is formally requesting Senate President Fann, Senator Petersen, Senate liaison Ken Bennett and contractors involved in the "audit" preserve documents and evidence as they may be subject to future legal claims", he said.

The letter only applies to the equipment that Maricopa County delivered to Fann's audit team at Veterans Memorial Coliseum in late April.

The demand also comes just one day after Arizona Secretary of State Katie Hobbs said any voting machines that have come into the hands of people carrying out the Republican-led "audit" are no longer safe to be used in future elections.

Following a week's pause, the Arizona Senate's audit is scheduled to restart next week, and organizers said this week they expect it to wrap up by the end of June.

"I have grave concerns regarding the security and integrity of these machines", Hobbs wrote to the Maricopa County Board of Supervisors, which is controlled 4-1 by Republicans.

"Decommissioning and replacing those devices is the safest option as no methods exist to adequately ensure those machines are safe to use in future elections", Hobbs wrote.

Cyber Ninjas has not disclosed its processes or procedures for handling the equipment; did not allow Hobbs' observers to remain with the equipment; and unlike the recount of almost 2.1 million ballots, did not provide a livestream of the equipment to the public, she added.

In an email, County Elections spokeswoman Megan Gilbertson said, "Unless the county, state, or vendor is confident that the device does not have malicious hardware or software installed, use the returned counting device".

"The voters of Maricopa County can rest assured that we will not use any equipment - ever - that could pose a risk to free and fair elections", election officials said in a statement.

The Maricopa County Elections Department released a memo "to document the analysis that the Elections Department and Recorder Office's Information Technology Teams performed in response to Senate President Karen Fann's letter dated May 12, 2021".

Fortunately for the county, it likely won't be on the hook for the cost of leasing new machines.

Before Maricopa County officials turned over subpoenaed ballots and voting equipment, Fann signed an agreement indemnifying the county from expenses that occur as a result of the election review.

Fann was not immediately available for comment.

The private company took custody of the machines as part of a Republican-led "audit".

The county hired several firms to conduct the audit, led by Cyber Ninjas, a Florida-based firm that has no election experience before 2020 and is led by a Trump supporter who has promoted election conspiracies. Dominion, which is also Fulton County's vendor, concluded that the county violated its licensing agreement with the company by giving an unaccredited and non-certified company access to the machines without any authorization from Dominion.
